1. Agreement to Terms
By accessing or using the Asia Number One mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our App.
These Terms constitute a legally binding agreement between you and Yang & Nian GmbH ("we," "our," or "us").
2. Service Description
Asia Number One is a mobile food ordering application that allows customers to:
- Browse our restaurant menu
- Place food orders for pickup or dine-in
- Make secure payments through the App
- Track order status
- Save favorite items and order history
3. Account Registration
3.1 Account Creation
To use certain features of the App, you must create an account by providing:
- Your full name
- Valid email address
- Phone number
- Physical address
- Secure password
3.2 Account Responsibilities
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized access
- Providing accurate and current information
3.3 Account Eligibility
You must be at least 16 years old to create an account and use our services.
4. Orders and Payments
4.1 Placing Orders
When you place an order through the App:
- You make an offer to purchase the selected items
- We reserve the right to accept or decline your order
- Order confirmation constitutes acceptance of your offer
- All prices are in Swiss Francs (CHF) and may include or exclude applicable VAT depending on your order type (takeaway or dine-in)
4.2 Payment Processing
Payments are processed securely through Stripe, Inc. We accept:
- Credit and debit cards (Visa, Mastercard, American Express)
- Apple Pay
- Google Pay
- Twint
Payment is charged immediately upon order confirmation.
4.3 Pricing
- All prices are subject to change without notice
- Prices displayed at the time of order placement apply
- We reserve the right to correct pricing errors
- Applicable taxes are calculated and displayed before payment
4.4 Order Modifications
Once an order is confirmed, modifications may not be possible. Contact us immediately at +41 41 440 04 72 if you need to modify or cancel an order.
5. Refunds and Cancellations
5.1 Refund Policy
We offer immediate refunds for:
- Orders cancelled before preparation begins
- Incorrect or defective items
- Service failures on our part

- Refunds are processed immediately upon approval
- Funds typically appear in your account within 5-10 business days
5.3 Non-Refundable Situations
We reserve the right to decline refunds for:
- Change of mind after order preparation has begun
- Failure to pick up orders (no-shows)
- Dissatisfaction with taste (subjective preferences)
6. User Conduct
You agree not to:
- Use the App for any illegal or unauthorized purpose
- Violate any laws in your jurisdiction
- Infringe upon intellectual property rights
- Transmit viruses, malware, or harmful code
- Attempt to gain unauthorized access to our systems
- Harass, abuse, or harm other users or our staff
- Use automated systems (bots) to access the App
- Reverse engineer or decompile the App
- Place fraudulent orders or use stolen payment methods
7. Intellectual Property
7.1 Our Rights
All content in the App, including but not limited to:
- Text, graphics, logos, images
- Software and source code
- Menu descriptions and recipes
- Trademarks and branding
are the property of Yang & Nian GmbH and protected by Swiss and international copyright laws.
7.2 Limited License
We grant you a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.
8. Disclaimers and Limitations of Liability
8.1 Service Availability
The App is provided "as is" and "as available." We do not guarantee:
- Uninterrupted or error-free service
- Availability at all times
- Compatibility with all devices
- Accuracy of all information
8.2 Limitation of Liability
To the maximum extent permitted by Swiss law, Yang & Nian GmbH shall not be liable for:
- Indirect, incidental, or consequential damages
- Loss of profits, data, or business opportunities
- Damages exceeding the amount paid for the order in question
8.3 Food Allergies and Dietary Restrictions
While we provide allergen information and accommodate special requests, we cannot guarantee a completely allergen-free environment. If you have severe allergies, please contact us directly before ordering.
9. Privacy and Data Protection
Your use of the App is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information in compliance with Swiss FADP and EU GDPR.
10. Third-Party Services
Our App integrates with third-party services:
- Stripe: Payment processing
- Google Firebase: Authentication, database, and hosting
Your use of these services is subject to their respective terms and privacy policies. We are not responsible for third-party services.
11. Account Termination
11.1 Termination by You
You may close your account at any time by contacting us at ebikon@asianumberone.ch.
11.2 Termination by Us
We reserve the right to suspend or terminate your account if you:
- Violate these Terms
- Engage in fraudulent activity
- Abuse our staff or other users
- Repeatedly fail to pick up orders
You may also request permanent deletion of your account and associated data through the App settings or by contacting us directly.
12. Modifications to Terms
We may modify these Terms at any time. Changes will be effective upon posting to this page. Continued use of the App after changes constitutes acceptance of the modified Terms.
We will notify you of material changes via:
- Email notification
- In-app notification
- Update to the "Last Updated" date
13. Governing Law and Dispute Resolution
13.1 Governing Law
These Terms are governed by the laws of Switzerland, specifically the Canton of Schwyz, without regard to conflict of law principles.
13.2 Dispute Resolution
Any disputes arising from these Terms or your use of the App shall be resolved through:
- Informal Resolution: Contact us first to resolve the issue amicably
- Mediation: If informal resolution fails, we agree to mediation
- Arbitration/Court: Disputes shall be subject to the exclusive jurisdiction of the courts of Schwyz, Switzerland
14. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
